Welcome to Damascus Moment. These Terms of Service (“Terms”) govern your access to and use of the Damascus Moment website (the “Site”) and the purchase of our retail fragrances and Private Label manufacturing services. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, then you may not access the website or use any services.

1. General Conditions

By agreeing to these Terms, you represent that you are at least the age of majority in your state or country of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). We reserve the right to refuse service to anyone for any reason at any time.

2. Retail Products and E-Commerce (B2C)

  • Product Descriptions: We have made every effort to display as accurately as possible the colors, packaging, and descriptions of our products. However, we cannot guarantee that your computer monitor’s display of any color will be accurate.
  • Availability: All products are subject to availability. We reserve the right to discontinue any product at any time.
  • Modifications: Prices for our retail products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time.

3. Private Label & Manufacturing Services (B2B)

For clients utilizing our Private Label and bespoke manufacturing services, the following specific terms apply:

  • Inquiries & Quotes: Submitting a Private Label inquiry through our website does not constitute a binding manufacturing contract. All projects are subject to technical review, formulation approval, and a formal agreement.
  • Minimum Order Quantities (MOQs): Private label manufacturing is subject to MOQs. Custom bottle molds and specialized packaging typically require higher MOQs and extended lead times, which will be clearly outlined in your custom manufacturing contract.
  • Sampling & Approvals: Before mass production begins, a sample will be provided for your approval. Once the sample is approved in writing, any subsequent changes to the formulation or packaging may incur additional costs and delays.
  • Intellectual Property: Unless explicitly stated otherwise in a separate manufacturing agreement, the proprietary fragrance formulas developed by Damascus Moment remain the intellectual property of Damascus Moment.

4. Pricing, Taxes, and Payment

  • Currency: All prices are listed in USD ($) unless otherwise noted.
  • Taxes and Duties: For international shipments, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders may be subject to import taxes, customs duties, and fees levied by the destination country, which are the sole responsibility of the customer.
  • Billing Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

5. Shipping and Delivery

We strive to process and ship retail orders promptly. However, shipping times may vary depending on the destination and customs processing. For Private Label clients, delivery timelines will be strictly governed by the specific manufacturing agreement and production schedule agreed upon. Damascus Moment is not liable for delays caused by shipping carriers or international customs clearance.

6. Returns and Refunds

  • Retail Orders: Due to the personal nature of our products and hygiene regulations, we only accept returns of retail fragrances if the product is returned within 14 days of receipt, completely unopened, in its original packaging, and with all tamper-evident seals intact.
  • Private Label & Custom Orders: Because Private Label products are custom-manufactured to your specific requirements, all B2B and custom manufacturing sales are final. We do not accept returns or offer refunds on Private Label orders once production has commenced, except in cases of proven manufacturing defects.

All content included on this Site—such as text, graphics, logos, images, audio clips, digital downloads, and data compilations—is the property of Damascus Moment or its content suppliers and protected by international copyright laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

8. Limitation of Liability

In no case shall Damascus Moment, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service.

9. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services, including Private Label manufacturing contracts, shall be governed by and construed in accordance with the laws of the Syrian Arab Republic. You agree that any legal action or dispute arising out of or relating to these Terms, our Services, or your purchases shall be subject to the exclusive jurisdiction of the competent courts located in Damascus, Syria.
